Source vs. amount
The amount authorized for bail and the lawful source of the proposed security are different questions.

Understanding Source-of-Bail Hearings and Release Restrictions
A “1275 hold” commonly means a PC §1275.1 source-of-bail proceeding, not a special premium or a charge with one bail amount. The court examines whether proposed consideration, security or indemnification was feloniously obtained. Lawful source information and judicial approval are separate from merely knowing the authorized bail amount.
A bail agent cannot independently remove a source-of-funds hold or bypass judicial review.

01 / What Is a 1275 Hold?
Clear information. Case-specific next steps.
The commonly used phrase generally refers to PC §1275.1. It concerns a potentially felonious source of bail consideration, security or indemnification—not whether a contributor happens to be related to the defendant, and not an automatic restriction for a particular charge.
The amount authorized for bail and the lawful source of the proposed security are different questions.
The statutory probable-cause procedure requires a judge or magistrate. A provider cannot approve away the hold.
Cash, pledged security and indemnification can be relevant. A family relationship does not by itself establish a lawful source.
Resolving a source concern does not erase unrelated warrants, supervision restrictions or facility checks.
Drug and weapons allegations may coexist with a source inquiry, but neither label automatically creates the hold. General felony release guidance does not replace the required source-of-funds proceeding.

02 / PC 1275 vs. PC 1275.1
Keep separate questions separate.
These adjacent code sections serve different functions. Do not use the shorthand “1275” to suggest their standards are identical.
A source-of-funds proceeding is not a punishment finding and does not establish guilt of the underlying charge.
03 / Why a 1275.1 Hold May Be Requested
Current law and individual orders matter.
Legal framework
Read the exact statutory provision with counsel; these summaries do not assess an individual case.
PC §1275.1
PC §1275
A 1275 hold can pause release.
04 / What Happens When a Hold Is Ordered?
Verify the actual status before paying.
A financial amount may already be authorized, but it does not answer whether the proposed consideration satisfies the source rules.
Amount alone is insufficientThe judicially ordered restriction prevents acceptance/release through the proposed bail until statutory requirements are met.
No agent overrideCounsel coordinates relevant truthful records and the required examination; preserve the actual source history.
Do not fabricate documentationWhen the defendant meets the statutory burden, the court must release the hold under the provision.
Judicial decision, not private approvalThe authorized undertaking and other release requirements still need attention; separate holds can remain.
No release-time guaranteeDo not pay on an assumption that a premium, collateral pledge or provider’s assurance substitutes for the court’s decision.

PC §1275.1
A judge or magistrate may order the hold on a qualifying sworn peace-officer or prosecutor declaration, or the judicial officer’s own probable-cause determination concerning feloniously obtained consideration.
Ask counsel to verify the actual declaration, judicial determination and pending hearing.
Constitutional framework
In re Humphrey concerns financial detention and ability-to-pay review. It does not eliminate §1275.1 source requirements, approve an unlawful contribution or authorize a bond provider to cancel a hold.
06 / Documents That May Help Establish a Lawful Source
Different circumstances. Different requirements.
Authentic pay records, tax or account information may help trace lawful earnings and savings. Relevance and required scope depend on counsel and the court.
Account statements and transfer records may help show the actual movement of funds. Provide them only through counsel and the appropriate legal process.
Truthful loan records and documented repayment sources may be relevant. A loan does not automatically prove that every part of its source is lawful.
Ownership, equity and title information may be needed when property secures the undertaking. Cash is not the only form of consideration examined.
Contributor identity and the actual source of a third party’s funds remain subject to review; a family or personal relationship alone does not establish lawfulness.
The court and legal counsel determine which evidence is appropriate; no universal document list applies.
Keep source records intact, with dates and accurate descriptions.
Be prepared to identify lawful contributors and explain actual transactions truthfully.
Ask counsel which records are relevant and how to provide them through an appropriate private channel.
The three-step inquiry is not a source-of-funds document portal. Do not place bank details in public messages.
Do not rename transactions, invent loans or omit contributors to create a false source story.
Records help explain facts; the court—not a checklist—decides whether the statutory burden is met.
This is an informational list, not a required-document package or a method to bypass judicial review.

PC §1275.1 — judicial hold
View official statute: PC §1275.1 — judicial hold (opens in a new tab)Identify the authorized amount and actual proposed consideration.
Verify the declaration or judicial probable-cause determination.
Provide authentic records through counsel and the appropriate court process.
The defendant must meet the applicable preponderance burden; no result is guaranteed.
Process a permitted undertaking only after lawful restrictions are resolved; facility checks remain.
PC §1275.1(g)’s 24-hour rule concerns a declaration awaiting judicial action. A valid judicially ordered hold is not automatically terminated merely because 24 hours pass, and an unrelated warrant, hold or detention order can still affect release.
09 / How a Bail Bond Works After Court Approval
Source review before an authorized undertaking.
The court must resolve the hold as required by law. Financial processing is not a substitute for the hearing.
Identify the person, agency, case and current bail order.
Counsel reviews the actual hold, declaration and procedural status.
Provide truthful relevant evidence; the court determines whether the statutory burden is met and approves the bond consideration.
Discuss filed premium, lawful security, collateral and indemnity before signing.
The facility processes permitted release after all remaining restrictions are addressed; court obligations continue.
10 / Costs and Financial Responsibilities
Premium, collateral and full-bond liability are separate.
There is no universal “1275 hold price.” Court-authorized bail, filed premium, collateral and counsel’s legal fees are distinct; no hearing fee or agency rate is invented.
California premiums are most commonly around 10% in general practice. The surety’s filed rate and applicable rules determine the actual charge; no Set Free rate is verified or quoted here.
Security may be required separately from the premium. Read what property is pledged, return conditions and the co-signer’s potential full-bond liability before signing.
If approved, installments spread the premium over time. Ask about the initial payment, balance, due dates and permitted costs; no discount or approval is promised.
The premium is generally not refunded simply because charges are dismissed or the defendant is acquitted. Contract terms and lawful exceptions matter. Cash bail and collateral have different return rules.
Where a lawful nonfinancial pathway is authorized, a commercial bond and its premium are unnecessary. MR is review, not a fee quotation.
11 / What Families Should Prepare
Start with what you know.
Confirm identity, booking number, facility and court case details.
Ask counsel whether there is a declaration awaiting action or a valid court-ordered source hold.
Identify the assigned court, pending hearing and current authorized bail order.
Preserve authentic income, savings, transfer, loan and property records as relevant; do not manufacture explanations.
Discuss truthful contributor, security and indemnification details privately with counsel.
Review premium, collateral, indemnity and other release restrictions only when processing is authorized.
You do not need every record before asking for help. Keep sensitive documents private; this checklist does not collect or save answers.

Yes. The common shorthand generally refers to §1275.1’s examination of potentially feloniously obtained bail consideration, security or indemnification. PC §1275 itself addresses factors in fixing bail.
No. The statutory probable-cause basis and judge or magistrate’s determination must be established. A booking label alone does not create the hold.
A judge or magistrate under §1275.1’s statutory procedure. Qualifying sworn declarations from a peace officer or prosecutor, or the judicial officer’s own probable-cause determination, can provide the basis.
After probable cause is determined, the defendant must show by a preponderance of the evidence that no part of the consideration was feloniously obtained. Counsel should explain what evidence is relevant.
Not while a valid source hold prevents the proposed undertaking. The lawful-source determination is separate from the amount, premium and facility release process.
No. An agent cannot substitute private approval, a collateral pledge or a premium payment for the court’s statutory determination.
Lawful family contributions may be involved, but relationship alone does not establish the source. The proposed consideration, security and indemnification remain subject to applicable review.
Potentially, if the actual source and arrangement satisfy applicable law and review. A third-party contribution is neither automatically rejected nor automatically approved.
A genuine lawful loan may be relevant, but its authenticity and source still matter. Counsel should evaluate the actual transaction and required evidence; no loan approval is promised.
Authentic income, savings, transfer, loan, property or transaction records may help trace lawful sources. Required scope depends on counsel and the court. Do not submit bank records through the public inquiry form.
No automatic release is promised. PC §1275.1(g) provides that if a filed declaration is not acted upon within 24 hours, the defendant shall be released upon posting the set bail, subject to other custody restrictions. A valid judicially ordered source-of-bail hold is different: it is not automatically terminated merely because 24 hours pass and requires the statutory resolution process.
No universal duration is promised. Judicial action, the record, evidence preparation and court scheduling can affect proceedings. A bond provider cannot guarantee the hearing result or release time.
The court must release the source hold under §1275.1 and release under the authorized bail amount. Unrelated holds or custody restrictions must still be identified and addressed.
The authorized amount and surety’s applicable filed rate determine the premium. Collateral, indemnity and legal representation costs are separate. There is no special universal “1275” premium quoted here.
Another case, warrant, supervision restriction, unresolved authorized bond or facility processing may remain. Resolution of one source hold does not erase every ground for custody.
